PASSENGER CARRIAGE TERMS AND CONDITIONS

These Terms and Conditions set out the provisions that apply between the Passenger and Cruise Saudi in relation to any Cruise taken by the Passenger on a Cruise Ship. They include detailed provisions of the relationship between the Passenger and Cruise Saudi and their respective responsibilities and liabilities. They are binding on the Passenger and Cruise Saudi.

When the Passenger enters into a Passage Contract with Cruise Saudi, or a Travel Agent these Terms and Conditions form part of that Passage Contract.

Please read these Terms and Conditions carefully.

1. INTRODUCTION

When reviewing these Terms and Conditions please note the following capitalised terms have the following meanings:

Applicable Law means any law, rule or regulation which might apply to the Cruise, Cruise Ship, Passenger or Passage Contract, in force from time-to-time, including but not limited to the flag state of the Cruise Ship and the laws of the relevant port, when the Cruise Ship is in port, or internal waters of a country or territory when the Cruise Ship is sailing within those internal waters, or if a Passenger is ashore, the laws of the country or territory when the Passenger is ashore, or any applicable international law.

Carrier means the carrier under the Passage Contract and includes Cruise Saudi, the carrying vessel including the Cruise Ship, its owner, charterer, operator, any tenders or other means of marine transport provided by Cruise Saudi to the Passenger.

Cruise means the scheduled voyage on any specified Cruise Ship or any substitute vessel as set out in more detail in the Passage Contract or the Itinerary.

Cruise Fare means the amount payable by the Passenger for the Cruise as set out in the Booking Conditions. For the avoidance of doubt the Cruise Fare does not include any other amount payable by the Passenger including but not limited to Fuel Taxes, Fees and Port Expenses, applicable service charges, tips, food, beverages, Shore Excursions, laundry charges, telephone or cellular calls, and WI-FI connection charges.

Cruise Saudi means Red Sea Cruise Company, trading as "Cruise Saudi".

Cruise Ship means the vessel named in the relevant Passage Contract or any substituted vessel owned, chartered, operated or controlled by Cruise Saudi.

Departure Date means the anticipated date of embarkation of the Cruise Ship from the first port as stated in the Itinerary, as may be varied in accordance with the Booking Conditions.

Dangerous Goods has the meaning given in Clause 3.3.

Deposit means the initial payment made by the Passenger to Cruise Saudi (whether directly or indirectly through a Travel Agent) to secure the booking of the Cruise.

Disabled Passenger means, in relation to any Passenger, any person:

(a)whose mobility when using transport is reduced as a result of any physical disability (sensory or locomotor, permanent or temporary) intellectual or psychosocial disability or impairment, or any other cause of disability and whose situation needs appropriate attention and adaption to their particular needs for the service made available to all Passengers;

(b)who has been clinically diagnosed with any disorder or disability of the mind;

(c)who has a visual or auditory impairment; and

(d)who has a state of arrested or incomplete development of the mind which includes significant impairment of intelligence and social functioning.

Documentation means the valid and correct documents required by any port on the Itinerary including but not limited to, a ticket, the Passage Contract, a valid passport or other travel document, any visa, entry or exit permit, vaccination cards, travel insurance details (if required) and proof of travel (if applicable).

Fuel Supplement has the meaning given in Clause 8.3.

Itinerary means the scheduled itinerary of the Cruise as published in any Cruise Saudi official documentation, including the Passage Contract or appearing on Cruise Saudi's website.

Luggage means any baggage, packages, suitcases, trunks or other personal items belonging to or carried by any Passenger, including cabin luggage, hand luggage and articles worn by or carried on the persons of the Passenger or deposited with the purser for safe custody.

Master means the captain or person in charge of and commanding the Cruise Ship at any given point.

Minor means any person under the age of eighteen (18) years of age. All references to Minor (singular) shall include the plural and vice versa.

Package means the pre-arranged combination of not fewer than two (2) of the following when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four (24) hours or includes overnight accommodation: (a) any and all modes of transport; (b) accommodation; and (c) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the Package. This includes, but is not limited to, any pre- or post- Cruise Package which meets the aforementioned criteria. All references to the Package (singular) shall include the plural and vice versa.

Passage Contract means the contract of carriage, which the Passenger has entered into with Cruise Saudi or the Travel Agent, the terms of which are evidenced by the Booking Conditions, these Terms and Conditions and Cruise Saudi's website (https://www.cruisesaudi.com/).

Passenger means all persons, including Minors and Disabled Passengers, traveling under a Passage Contract and each person's heirs and personal representatives. All references to the Passenger (singular) shall include the plural and vice versa. All references to "you" and "your" shall be in reference to the Passenger and shall be construed accordingly.

SAR means Saudi Arabian Riyals, the lawful currency of Saudi Arabia.

Saudi Arabia or means the Kingdom of Saudi Arabia. The terms Saudi and Saudi Arabian shall be construed accordingly.

Shore Excursion means any excursion operated by Cruise Saudi or third-party contractors and offered for sale by Cruise Saudi or the Travel Agent, for which a separate charge is payable, whether booked prior to commencement of the Cruise or onboard the Cruise Ship. All references to Shore Excursion (singular) shall include the plural and vice versa.

Smoking Policy has the meaning given in Clause 15.

Surcharges has the meaning given in Clause 8.

Taxes, Fees and Port Expenses means any taxes, fees and expenses assessed to be due on a per Passenger, per Cruise Ship, per ton or per berth basis, as may change from time to time. This includes without limitation, all or a portion of the following:

(a)taxes, tolls, fees, and charges paid to Saudi Arabia, or any governmental or quasi-governmental authorities in any other relevant jurisdiction (including any taxes, tolls, fees and charges to be paid at any port or country listed on the Itinerary), such as head taxes, value added taxes, goods and services taxes, dockage fees, wharfage fees, customs and immigration fees, inspection fees, security fees, passenger facilities charges, canal tolls, flight segment fees, and international arrival and departure taxes; and

(b)port expenses associated with navigation (pilotage), berthing, stevedoring, baggage handling, storage and security services.

Total Fare means the Cruise Fare payable under the Passage Contract, together with any other additional amounts payable by the Passenger in the event that the Passenger has booked a Package. For the avoidance of doubt the Total Fare does include any other amount payable by the Passenger including but not limited to fuel cost increase, Taxes, Fees and Port Expenses, applicable service charges, tips, food and beverages in main restaurants, Shore Excursions, laundry charges, telephone or cellular calls, and WI-FI connection charges.

Travel Agent means any authorized third party approved by Cruise Saudi with which the Passenger has entered into a Passage Contract for a Cruise or package, which includes the Cruise onboard the Cruise Ship or other equivalent.

USD means United States Dollars, the lawful currency of the United States.

A reference in these Terms and Conditions to the calendar (or to any sub-division of the calendar, including but not limited to a month or a year) refers to the Gregorian calendar (or to any sub-division of the Gregorian calendar).

2. TRAVEL DOCUMENTATION OBLIGATIONS

2.1 Subject to Clause 2.2, each Passenger is under an obligation to ensure that they have a valid Passage Contract together with the required Documentation for the Cruise and shall be liable to Cruise Saudi for any fines or penalties imposed on the Cruise Ship or Cruise Saudi by any authorities for the Passenger’s failure to have the required Documentation in place in order to complete the Cruise, any element of the Package or any Shore Excursion including any failure to observe or comply with local governmental laws or regulations, such as requirements relating to immigration, customs or excise. Each Passenger shall ensure that they always have the required Documentation for the Cruise and a valid Passage Contract on their person.

2.2 Where the Passenger is a Minor, the parent or guardian of the Minor shall be responsible for ensuring that the Minor has a valid Passage Contract together with the required Documentation for the Cruise. The parent or guardian of the Minor shall be liable to Cruise Saudi for any fines or penalties imposed on the Cruise Ship or Cruise Saudi by any authorities for the Minor's failure to have the required Documentation in place in order to complete the Cruise, any element of the Package or any Shore Excursion including any failure to observe or comply with local governmental laws or regulations, such as requirements relating to immigration, customs or excise. The parent or guardian of the Minor shall ensure that the Minor always has the Passage Contract and the required Documentation on their person.

2.3 Cruise Saudi reserves the right to check and record details of such Documentation. Cruise Saudi makes no representation and gives no warranties as to the correctness of any Documentation, which is checked. Passengers are strongly advised to check for all legal requirements for traveling abroad and at the various ports to include the requirement of visas, immigration, customs and health.

2.4 Cruise Saudi may cancel the booking of any Passenger who is or becomes ineligible to travel for any reason, who is traveling without the required Documentation, or who fails to abide by Cruise Saudi's Infectious Diseases Protocols (as described in Clause 13 below or as set out on Cruise Saudi's website). Any such Passengers, or any Passenger who fails to follow Cruise Saudi's Infectious Diseases Protocols or to board the Cruise Ship at embarkation, shall be ineligible to board the Cruise Ship thereafter without Cruise Saudi's consent, and shall not attempt to do so at the same or any other port.

3. INSPECTION

3.1 The Passenger shall present themselves for boarding before the scheduled departure in accordance with the instructions provided, in order to complete any pre-boarding procedures and security inspections. The Passenger is the sole person responsible for and shall comply with any governmental travel requirements, laws or regulations for all ports of call on the Itinerary. All Passengers must present the required Documentation for inspection by Cruise Saudi or any relevant government authority.
3.2 For security reasons, the Passenger agrees to and provides their consent for agents of Cruise Saudi may search the Passenger, their Luggage, and any accompanying property, whether or not that property or Luggage is locked, and with or without notice to the Passenger.

3.3 Cruise Saudi shall have the right to confiscate any Dangerous Goods, which for the purposes of these Terms and Conditions means any and all articles carried or contained in any Luggage, on any Passenger, or in the Passenger's possession which:
(a) Cruise Saudi, in its sole discretion, considers dangerous or poses risk or inconvenience to the security of the Cruise Ship or persons onboard (including but not limited to any articles that can be used as a weapon, explosives, illegal or dangerous goods); or
(b) are dangerous or unlawful under any Applicable Law.

3.4 Passengers are prohibited from bringing onboard any Dangerous Goods.


3.5 Cruise Saudi reserves the right to search any cabin or other part of the Cruise Ship at any time for security reasons, whether or not that cabin or area of the Cruise Ship is locked, and with or without notice to the Passenger.

3.6 Cruise Saudi will not be liable for any loss or damage caused to the Passenger, or their Luggage or property as a result of the Passenger carrying any Dangerous Goods in breach of these Terms and Conditions. Cruise Saudi is under no obligation to keep any Dangerous Goods or articles confiscated under Clause 3.3 for and on behalf of the Passenger.

4. Passenger's Luggage and Personal Property

4.1 Passengers are encouraged to limit their checked Luggage to two (2) suitcases and two (2) pieces of hand luggage per Passenger and all Luggage must be securely packed and distinctly labeled. Cruise Saudi shall not be liable for loss, damage or delay in delivery of any Luggage, if the Luggage is not sufficiently labeled, nor shall Cruise Saudi be responsible for any fragile or perishable property carried by the Passenger.

4.2 During repositioning cruises, the above guidelines represent the maximum limit allowed per Passenger, provided that, in any case, the maximum amount of Luggage in each cabin does not exceed [one hundred kilograms (100)] kg or [eight (8) pieces] among all Passengers in the same cabin. If Passengers are arriving at the Cruise via air flights, Cruise Saudi requests that Passengers check with their respective airlines regarding baggage allowance i.e., weight and size restrictions.

4.3 All Luggage is to be kept in the cabin, keeping all exits free of any obstacles and shall include only personal belongings, any commercial property shall be subject to an additional charge.

4.4 Passengers with their own wheelchairs must check that suitable accommodation is available at the time of booking, and a written addendum is signed by the Passenger and Cruise Saudi and is added to these Terms and Conditions. If any Passenger requires any other mobility equipment, this must be notified at the time of booking or within a reasonable time prior to the Cruise to enable Cruise Saudi to assess whether such equipment can be carried safely. It is the Passenger’s responsibility to ensure that such mobility equipment is in good working order and that the Passenger can operate such equipment.

4.5 Luggage must not be left unaccompanied at any time, unless different and reasonable instructions are given by any authorized Cruise Saudi personnel. Unaccompanied Luggage may be removed or destroyed by Cruise Saudi, its agents or employees.

4.6 The Passenger shall not bring onboard the Cruise Ship any goods or articles of an inflammable or dangerous nature (including but not limited to shisha tobacco and hookah smoking devices), nor any controlled or prohibited substance under the Applicable Law. Breach of these conditions and regulations shall render the Passenger strictly liable to Cruise Saudi for any injury, loss, damage or expense or to indemnify Cruise Saudi against any claim, or final penalty arising from such breach. The Passenger may also be liable for statutory fines or penalties. Cruise Saudi shall not be liable for loss or damage to Luggage or property while in the custody or control of stevedores or other independent shoreside contractors, and all Luggage must be claimed upon arrival of the Cruise Ship at the final port or it will be stored at the Passenger's risk and expense.

4.7 The Passenger shall not be liable to pay or receive any general average contribution in respect of Luggage or personal effects or property.

4.8 Cruise Saudi shall have a lien upon and the right to sell by auction or otherwise, without notice to the Passenger, any Luggage or other property belonging to any Passenger in satisfaction of unpaid monies or of any other monies which may in any way have become due by the Passenger to Cruise Saudi or to its servants, agents or representatives.

4.9 Cruise Saudi will not be liable for any loss or damage caused to the Passenger, or their Luggage or property as a result of the Passenger breaching any provision of this Clause 4, or any Luggage or property being confiscated as a result thereof.

5. ACCOMMODATION

A Passenger shall not have the right to exclusive occupancy of a cabin with two (2) or more berths unless they have paid supplement for exclusive occupation. Cruise Saudi reserves the right to transfer the Passenger from one cabin to another and may adjust the Cruise Fare accordingly.

6. NON-TRANSFERABILITY AND AMENDMENT

Cruise Saudi agrees to transport the Passenger on the Cruise on named or substitute vessels. The Passenger agrees to be bound by all its terms, conditions and limitations. All prior oral or written agreement is superseded by these Terms and Conditions. These Terms and Conditions cannot be amended without written and signed consent from Cruise Saudi or its authorized representative. The Passage Contract issued by Cruise Saudi, or a Travel Agent is valid only for the Passenger or Passengers for whom it is issued, for the Cruise on the date specified and on the Cruise Ship and Itinerary indicated or any substitute vessel and is not transferable.

7. OVERBOOKING

7.1 The Passenger agrees that Cruise Saudi and its Travel Agent retains the right to overbook Passenger accommodation and Shore Excursions. In the event that the Passenger accommodation or a Shore Excursion referenced in the Passage Contract is overbooked, or if Cruise Saudi determines that the Cruise Ship is overbooked, Cruise Saudi has the right at its discretion to deny boarding or a Shore Excursion ticket to any Passenger and if necessary, refund all or part of the monies paid or offer non-transferable future Cruise credit or Shore Excursion credit.

7.2 Unless operated by Cruise Saudi, Cruise Saudi shall not be responsible for any and all Shore Excursion, travel, excursion or other activity or service that is booked through, offered or provided by a third-party. Cruise Saudi shall not be liable for any damage or loss caused to persons or property of the Passenger, in the event that a third-party cancels, overbooks, fails to perform or otherwise breaches its obligations in providing a service described in this Clause 7.2.

8. EXTRA CHARGES

8.1 The Passenger shall pay in full all charges for goods and services incurred by Cruise Saudi on their behalf before the end of the Cruise in any currency in general use onboard the Cruise Ship at the time of payment.

8.2 Beverages and food served in specialty restaurants, and any medical expenses, any independent contractor services or products, Shore Excursions or any fees, charges or taxes imposed by any government agency (including Taxes, Fees and Port Expenses) shall be extra charges unless otherwise stated as included at the time of the Cruise.

8.3 After the booking is confirmed, but before the balance is received and in any case at least 60 days before departure, Cruise Saudi reserves the right to increase the price of the Cruise Fare only if there is an increase in the costs of fuel (“Fuel Supplement”) according to the NYMEX (New York Mercantile Exchange Index). Cruise Saudi shall bear any increase in costs up to an amount equivalent to 2% of the price of the confirmed Cruise, and shall be entitled to charge increases where they exceed 2% of the price of the Cruise. If the increases exceed 8%, the passenger may withdraw from the contract and obtain a full refund of the amount paid. For clarity, the Cruise Fare or Total Fare does not include Fuel Supplement charges, security surcharges, or similar incidental surcharges (Surcharges). Subject to Applicable Law, Cruise Saudi reserves the right to impose or pass any of these Surcharges and no right of cancellation shall be implied. A Fuel Supplement shall mean any additional charge to defray a portion of Cruise Saudi's fuel costs. The amount of Fuel Supplements and government fees and taxes collected are subject to change. Cruise Saudi may at any time determine that the Fuel Supplement or any Surcharges are payable in a currency other than SAR or USD.

9. EARLY TERMINATION OR CANCELLATION OF THE CRUISE

9.1 At any time six (6) months before departure of the Cruise and whether or not the Cruise Ship may have deviated or have proceeded beyond the port of destination, Cruise Saudi may, by notice in writing to the Passenger, terminate or cancel the Cruise, if the performance or further performance is hindered or prevented by causes beyond the control of Cruise Saudi or if the Master or Cruise Saudi consider that such termination or cancellation is necessary for the management or safety of the Cruise Ship or persons onboard.

9.2 Any Cruise that is terminated in accordance with this Clause 9 shall be on the basis that Cruise Saudi will not have any liability to the Passenger whose sole remedy will be against Red Sea Cruise Company pursuant to the Applicable Law or the Passage Contract.

9.3 Before the Cruise begins, Cruise Saudi has the right to terminate or cancel the Cruise for any reason even without prior notice if it considers that it is necessary to do so for the safety of the Cruise Ship, or persons onboard.

9.4 Cruise Saudi expressly reserves the right to change the arrangements for the Cruise or the Holiday Package, should such changes become necessary or advisable for operational, commercial or safety reasons. In the event of a significant alteration to an essential term of the Passage Contract, the Company will inform the Passenger or his/her Sales Agent of such change in writing as soon as reasonably possible.

The Passenger will be offered the choice of:

a) Accepting the alteration; or

b) Booking another Holiday Package from the Cruise Saudi brochure and/or from the Official Website of equivalent or superior grade, if available; or

c) Booking another Holiday Package from Cruise Saudi brochure and/or from the Official Website of lower grade, if available, with a refund of the difference in price; or

d) Cancelling and receiving a full refund of all monies paid.

10. DELAYS AND VARIATIONS

10.1 The Cruise Ship's operation is subject to weather conditions, mechanical problems, vessel traffic, government intervention, duty to assist other vessels in distress, availability of berth facilities, and other factors that may be beyond Cruise Saudi's control.

10.2 Cruise Saudi does not guarantee that the Cruise Ship will call at every advertised port or follow any particular route or time schedule in the Itinerary. The Master and Cruise Saudi shall have an absolute right to alter or substitute the advertised Itinerary or route or substitute other vessels, without notice. If a scheduled port of embarkation or disembarkation is substituted, Cruise Saudi shall determine and arrange transportation to or from the substituted port at no extra cost or expense to the Passenger.

10.3 Cruise Saudi or the Master shall be at liberty to comply with any order or directions as to departure/arrival routes, ports of call, stoppages, trans-shipment, discharge or destination or otherwise given by any government or any department or by any person acting or purporting to act with the authority of any government or any department thereof or by any war risks insurance association working under any government scheme in which the Cruise Ship may be entered. Nothing done or not done under such orders or directions shall be deemed a deviation in law.

10.4 Any dates or times specified in any Itinerary, timetables or otherwise, which may be issued by the Travel Agent or Cruise Saudi, are only approximate and may be altered by Cruise Saudi at any time and to such extent as is considered necessary in the interest of the Cruise as a whole.

10.5 If the Cruise Ship shall be prevented or hindered by any cause whatsoever from sailing or proceeding in accordance with the Itinerary, Cruise Saudi shall be entitled to transfer the Passenger either to any other similar Cruise Ship or with the consent of the Passenger to any other means of transportation bound for the Passenger’s place of destination.

10.6 If the Cruise or the Cruise Ship is delayed as a result of a circumstance stated in Clause 10.1 or as a consequential result of delays suffered by an independent, third-party including but not limited to delays suffered by transport providers other than Cruise Saudi, Cruise Saudi shall not be liable for any delays suffered as a result thereof.

11. CANCELLATION BY PASSENGERS AND REFUNDS

11.1 Passengers must arrive on time at the port at their designated boarding appointment time stated in the Passage Contract or the Itinerary. Except as otherwise expressly provided in Cruise Saudi's Cancellation and Refund Policy, no refunds will be made in the event of "no shows", unused tickets, lost tickets, partially used tickets, or cancellations received late or after the start of the Cruise. Cruise Saudi strongly recommends the purchase of trip cancellation insurance that includes coverage for travel cancellation or interruptions related to pandemics or epidemics. Cancellation charges for individual bookings will be assessed as listed below.

11.2 For cancellation charges related to group bookings, partial ship charters or full ship charters refer to your charter contract or group booking agreement for terms and conditions.

11.3 Where the Passenger wishes to cancel a Cruise or Package for whatever reason, the Passenger must contact Cruise Saudi or if booked via a Travel Agent, the Travel Agent, and give notice in writing using registered mail or e-mail. The Package or Cruise will only be cancelled on the date Cruise Saudi received written notice of cancellation. Upon cancellation, the Passenger will have to pay the cancellation charges set out below and calculated on the Total Fare:

11.4 All cancellations by the Passenger shall be subject to Clause 11.3 above.

12. PASSENGERS’ HEALTH

12.1 In order to ensure that Cruise Saudi is able to carry passengers safely and in accordance with applicable safety requirements established by Applicable Law or in order to meet safety requirements established by competent authorities, including the flag state, the Passenger warrants that they are fit to travel by sea and that their conduct or condition will not impair the safety of the Cruise Ship or inconvenience other persons onboard.

12.2 If it appears to Cruise Saudi, the Master or the Cruise Ship’s doctor that a Passenger is for any reason unfit to travel, likely to endanger safety, or likely to be refused permission to land at any port, or likely to render Cruise Saudi liable for Passenger maintenance, support or repatriation, then Cruise Saudi or the Master shall have the right to take any of the following courses:

(a) to refuse to embark the Passenger at any port;

(b) to disembark the Passenger at any port;

(c) to transfer the Passenger to another cabin;

(d) if the Cruise Ship’s doctor considers it advisable, to place or confine them in the Cruise Ship’s hospital or to transfer the Passenger to a health facility at any port, at the Passenger’s cost and expense; and

(e) to administer first aid and administer any drug, medicine or other substance or to admit or confine the Passenger to a hospital or other similar institution at any port, at the Passenger’s cost and expense provided that the Cruise Ship’s doctor or Master considers that any such steps are necessary.

12.3 Unless provided under any Applicable Law, where a Passenger is refused embarkation as a result of safety or fitness to travel, Cruise Saudi shall not be liable for any loss or expense occasioned to the Passenger thereby, nor shall the Passenger be entitled to any compensation from Cruise Saudi.

12.4 The Cruise Ship has a limited number of cabins equipped for Disabled Passengers. Not all areas or equipment on the Cruise Ship are suitable for access to Disabled Passengers.

12.5 At the time of booking the Cruise, Disabled Passengers, or Passengers on behalf of a Disabled Passenger, are required to notify Cruise Saudi of the type and extent of any [certified] disabilities (whether physical or mental) and to inform Cruise Saudi of any specific needs they may have.

12.6 Cruise Saudi reserves the right to refuse passage to anyone who has failed to notify it of their specific needs with regard to accommodation, seating or services required from Cruise Saudi or any terminal operator, or their need to bring medical equipment, or to bring a recognised assistance dog onboard the Cruise Ship, or of any other known disabilities, or who in Cruise Saudi’s or the Master’s opinion is unfit or unable to travel, or anyone whose condition may constitute a danger to themselves or others onboard on the grounds of safety.

12.7 Passengers (including Minors and Disabled Passengers) who need assistance or have special requests, or need special facilities or equipment with regard to access, accommodation, seating or services required or their need to bring medical and mobility equipment, must notify Cruise Saudi or the Travel Agent at the time of booking. This is to ensure that the Passenger can be carried safely and in accordance with all applicable safety requirements. In order to ensure that Cruise Saudi can provide the necessary assistance and there are no issues relating to the design of the Cruise Ship or terminal infrastructure and equipment which may make it impossible to carry out the embarkation, disembarkation or carriage of the Passenger in a safe or operationally feasible manner. Cruise Saudi is not obliged, and makes no representations, promises or warranties, to provide any assistance or meet special requests under this Clause 12 unless Cruise Saudi has agreed to do so in writing. If the Passenger cannot be carried safely and in accordance with applicable safety requirements, then Cruise Saudi can refuse to accept a Passenger or embarkation of Passenger on the grounds of safety.

12.8 In the case of Minors who are Disabled Passengers or have special needs, the parents or guardians of the Minor are responsible for notifying Cruise Saudi of the Minor’s disabilities and needs under this Clause 12.

12.9 Those Passengers confined to wheelchairs must furnish their own standard size wheelchairs. The Cruise Ship’s wheelchairs are available for emergency use only.

12.10 Where Cruise Saudi considers it necessary for the safety of the Disabled Passenger it may require such Passenger to be accompanied by another person or a recognised assistance dog (in accordance with Clause 19) who is capable of providing the assistance required by that Passenger. Such evaluation will be based entirely on Cruise Saudi assessing the needs of the Passenger on grounds of safety and may vary from Cruise Ship to Cruise Ship and or Itinerary to Itinerary.

12.11 Where any wheelchair or mobility or other equipment is lost or damaged by the fault or neglect of Cruise Saudi then Cruise Saudi shall decide, at its sole discretion, whether to repair or replace such equipment. Unless Cruise Saudi agrees otherwise and in writing, Passengers are limited to bringing two (2) items of mobility or medical equipment onboard per cabin with a total value not exceeding SAR 11,250 All wheelchairs and other mobility or other such equipment must be capable of being carried safely and must be declared before the Cruise. Cruise Saudi may decline to carry such equipment where it is not safe to do so or where it has not been notified in time to enable a risk assessment to be carried out.

12.12 Any Passenger who embarks, or allows any other Passenger for whom they are responsible to embark, when they or such other Passenger is suffering from any sickness, disease, injury or infirmity bodily or mental or to their knowledge has been exposed to any infection or contagious disease, or for any other reason is likely to impair the safety or reasonable comfort of other persons onboard or for any reason is refused permission to land at their port of destination, shall be responsible for any loss or expense incurred by Cruise Saudi or the Master directly or indirectly in consequence of such sickness, disease, injury, infirmity, exposure or refusal or permission to land unless in the case of sickness, disease, injury, infirmity or exposure the same has been declared in writing to Cruise Saudi or the Master before embarkation and consent in writing of Cruise Saudi or the Master to such embarkation has been obtained. Passengers should ensure that they have the necessary equipment or medications that they may require for the duration of the Cruise, ensuring that any necessary prescriptions or evidence of medical necessity is evidenced and that any such medication complies with any Applicable Law.

12.13 Cruise Saudi reserves the right to require any Passenger to produce medical evidence of fitness to travel in order to assess whether that Passenger can be carried safely in accordance with any Applicable Law.

12.14 Pregnant women are highly recommended to seek medical advice prior to travel at any stage of their pregnancy. Cruise Saudi cannot for safety reasons carry pregnant Passengers of 24 weeks or more by the end of the Cruise. Cruise Saudi reserves the right to request a medical certificate at any stage of pregnancy and to refuse passage if Cruise Saudi or the Master are not satisfied that the Passenger will be safe during the passage.

12.15 Failure to inform Cruise Saudi and the Cruise Ship’s doctor of pregnancy will release Cruise Saudi from any liability to the pregnant Passenger.

12.16 The Cruise Ship’s doctor is not qualified to deliver babies onboard or to offer pre-natal or post-natal treatment. Cruise Saudi accepts no responsibility and does not make any warranties in respect of the ability to provide such services or equipment. Pregnant Passengers should also read Clause 23 headed “Medical Services and Treatment” for information regarding the medical facilities onboard.

13. INFECTIOUS DISEASE PROTOCOLS

13.1 Cruise Saudi has adopted specific Infectious Disease Protocols with input and guidance from the Saudi Arabian Ministry of Health and other health authorities. Passengers acknowledge that Cruise Saudi’s Infectious Disease Protocols may change from time to time and agrees to comply with the Infectious Disease Protocols as described herein and as they are set out on Cruise Saudi’s website at all times including at pre-embarkation, whilst onboard the Cruise Ship, during port calls, Shore Excursions and disembarkation. In case of any conflict between the Infectious Disease Protocols described in these Terms and Conditions and those on Cruise Saudi’s website, the details on the website shall take priority and the Passenger’s agreement to abide by said website constitutes an integral part of these Terms and Conditions.

13.2 Passengers acknowledge that Cruise Saudi’s Infectious Disease Protocols may include (but are not be limited to):

(a) completion of an accurate, truthful and complete health questionnaire in a form and containing any health or travel related questions as determined by Cruise Saudi in its sole discretion based on advice from government or health authorities or medical experts for each Passenger prior to boarding;

(b) pre-embarkation or periodic testing and temperature checks of each Passenger followed by a period of isolation until test results are available;

(c) modified capacity rules for activities (including but not limited to restaurants, gyms, and entertainment events onboard and for Shore Excursions) which may limit or eliminate the ability of the Passenger to participate in particular activities;

(d) mandatory use by each Passenger (except for Minors under the age of two (2) years) of face masks in most locations outside of the Passenger’s cabin while onboard, during embarkation, disembarkation and Shore Excursions;

(e) mandatory physical distancing of Passengers outside of their cruise companions (family or immediate travel group) at any/all times while onboard and during embarkation, disembarkation, and Shore Excursions;

(f) additional restrictions during shore excursions depending on local conditions, including but not limited to denial of disembarkation at destinations unless participating in only Cruise Saudi-approved Shore Excursions and denial of reboarding the Cruise Ship for any noncompliance by the Passenger or members of the Passenger’s travelling party with Infectious Disease Protocols;

(g) mandatory hand-sanitising by Passengers upon entry or exit of any public areas;

(h) confinement of Passengers to cabins, quarantine or emergency disembarkation of Passenger if, in Cruise Saudi’s sole discretion, such steps are necessary to prevent or slow the spread of any infectious disease;

(i) the required completion by the Passenger in a timely manner of any written authorisations or consent forms required for Cruise Saudi to carry out its Infectious Disease Protocols (including but not limited to medical information, medical privacy, or personal data privacy consent forms);

(j) vaccination of Passengers with documentary proof satisfactory to Cruise Saudi, according to the criteria set forth in the Infectious Disease Protocols in effect at the time of sailing; and

(k) other policies and procedures deemed by Cruise Saudi in its sole discretion to be necessary to reduce the risk of spread of an infectious disease.

13.3 Notwithstanding any other provision contained herein or in Cruise Saudi’s Cancellation and Refund Policy, any noncompliance by a Passenger or members of a Passenger’s travelling party with Cruise Saudi’s Infectious Disease Protocols or these Terms and Conditions shall be grounds for refusal to board, refusal to re-board after going ashore, quarantine onboard the Cruise Ship, disembarkation, reporting to governmental or health authorities, or other steps deemed necessary in Cruise Saudi’s sole discretion under the circumstances to protect the health and well-being of others. Under these circumstances, Passengers shall not be entitled to a refund or compensation of any kind. Passengers will be responsible for all related costs and fines, including without limitation travel expenses and for proper travel documentation for any port, or for departure from or arrival to the port of embarkation. Under no circumstances shall Cruise Saudi be liable for any damages or expenses whatsoever incurred by any Passenger as a result of such denial of boarding, refusal to re-board, quarantine, disembarkation, or any other steps taken by Cruise Saudi.

13.4 Passengers agree that if, at any time within five (5) days prior to embarkation, a Passenger tests positive for an infectious disease, exhibits signs or symptoms of an infectious disease, has had close contact with a person confirmed or suspected as having an infectious disease, or Cruise Saudi otherwise determines in its sole discretion that such Passenger is unfit to board because of any communicable illness, Cruise Saudi may deny boarding to such Passenger. In these circumstances, unless Cruise Saudi determines that Passenger has failed to comply with Cruise Saudi’s Infectious Disease Protocols or these Terms and Conditions, any Passenger denied boarding will be entitled to a future cruise credit equal in value to the amount the Passenger paid to Cruise Saudi, subject to the Passenger providing verification satisfactory to Cruise Saudi of results of tests administered by providers other than those retained by Cruise Saudi. If any Passenger wishes to cancel their Cruise booking for pandemic related issues, they must do so in accordance with Cruise Saudi’s Cancellation and Refund Policy. Cruise Saudi shall have no other liability or responsibility for compensation or other damages or costs, including but not limited to compensation for lodging or travel.

13.5 If, after boarding, and even if a Passenger has fully complied with all Infectious Disease Protocols, such Passenger tests positive for an infectious disease or exhibits signs or symptoms of an infectious disease, Cruise Saudi may disembark, refuse re-boarding after a Shore Excursion, or quarantine such Passenger as well as members of Passenger’s travelling party, or take other steps which Cruise Saudi determines, in its sole discretion, are necessary under the circumstances to protect the health and well-being of others. Under these circumstances, any such Passenger who is disembarked, refused re-boarding, or quarantined shall be entitled to a prorated future cruise credit for the unused portion of the Cruise Fare or Total Fare. Each such Passenger is responsible for all related costs and fines, including without limitation travel expense. Under no circumstances shall Cruise Saudi be liable to compensate any such Passenger or for any costs, damages or expenses whatsoever incurred by any Passenger.

14. MINORS

14.1 All the provisions of Clause 12 and the requirement of fitness to travel is applicable to all Passengers including Minors.

14.2 Unaccompanied Minors are not permitted to travel on Cruise Saudi ships and will not be allowed to embark unless they are accompanied by a parent or guardian or any other authorized person who is 18 years old or older and also a Passenger. Passengers (who are 18 years or older) traveling with a Minor shall be fully responsible for that Minor’s conduct and behavior.

14.3 Minors onboard must be supervised by a parent or guardian at all times and are welcome at the activities onboard or at Shore Excursions, provided that a parent or guardian is present. Minors cannot remain onboard if their parents or guardians go ashore, unless expressly authorized by the onboard Cruise Saudi staff.

14.4 For the avoidance of doubt, parent or guardian of any Minor will be responsible for ensuring that they comply with their obligations and responsibilities under these Terms and Conditions and the remaining terms of the Passage Contract.

14.5 Passengers (who are 18 years or older) travelling with a Minor shall be liable to Cruise Saudi and shall reimburse it for loss, damage or delay sustained by Cruise Saudi because of any act or omission of the Passenger or Minor.

14.6 Minors are subject to all the terms contained in these Terms and Conditions.

15. SMOKING

15.1 Passengers acknowledge that any and all forms of smoking, including but not limited to, cigarettes, cigars, pipes, vaporizers, shisha tobacco, hookah devices and electronic cigarettes are only permitted in designated areas exterior deck areas. Passengers acknowledge that all cabins, including the outside balconies, are non-smoking agree to refrain from smoking in non-designated areas and agree that Cruise Saudi has the right to assess up to a charge of SAR 1,000 per violation, and to disembark the Passenger for failure to observe Cruise Saudi's smoking policy (Smoking Policy) with no refund to the Passenger. Minors are prohibited from any and all forms of smoking, in any place whether onboard or not, during the Cruise, and the parents or guardians of any Minors shall be responsible for ensuring that the Minor complies with this Clause 15.1.

15.2 In accordance with Cruise Saudi’s Smoking Policy any possession or use of any illegal, controlled substances under any Applicable Law is strictly prohibited on all Cruise Saudi vessels at all times, regardless of local, state, or other laws which might permit use or possession of such substances. Any Passenger who brings illegal controlled substances onboard, in violation of Cruise Saudi’s policy or any Applicable Law will be reported to local or governmental authorities for possible detainment or enforcement action. Cruise Saudi may deny boarding or disembark any Passenger who brings or attempts to bring any illegal controlled substance onboard with no refund to the Passenger and at the Passenger’s own expense for repatriation and travel. The Passenger agrees to strictly comply with Cruise Saudi’s Smoking Policy. The Passenger further agrees that any violation of Cruise Saudi’s Smoking Policy would also cause Cruise Saudi to incur damages, including but not limited to, loss of goodwill, revenue, cleaning, maintenance, fines or other costs. Any evidence of smoking in a cabin or on a balcony, e.g. smoke smell/residue, butts, ashes, upholstery/furniture burns, tampering of the smoke alarm, will constitute a violation of Cruise Saudi’s Smoking Policy.

15.3 Passengers who violate Cruise Saudi’s Smoking Policy will be assessed a charge of SAR 1,000, per violation, on the Passenger’s onboard account, and may also result in the disembarkation of all Passengers in the cabin. Fines will be assessed in the functional currency of the Cruise Ship which may be different than the currency used to secure the booking. Such Passengers will be solely responsible for all resulting financial penalties and expenses to return home, and no refund of their fare will be provided. Passengers further acknowledge and agree that any violation of this policy shall, in the sole discretion of Cruise Saudi, constitutes a material breach of these Terms and Conditions. In the event of such breach, the Passenger forfeits all rights hereunder, including the right to remain onboard. Cruise Saudi reserves the right to disembark the Passengers at any port, as determined by Cruise Saudi. Cruise Saudi shall not be liable for any refund or other compensation or damages whatsoever to any Passenger disembarked pursuant to this provision, or who disembarks because another Passenger is so disembarked. Such Passengers may also be prohibited from sailing with Cruise Saudi in the future.

16. BEHAVIOUR AND CONDUCT

16.1 Cruise Saudi has a zero-tolerance policy toward any illegal activity or behavior by Passengers or crew aboard. Passengers agree to comply with this policy and further acknowledge that it is Cruise Saudi’s policy to report incidents of illegal activity or behavior to the appropriate law enforcement authorities. Cruise Saudi will cooperate with relevant authorities in any civil or criminal proceedings sought by those agencies. For the safety of the Cruise Ship and of other Passengers and crew, Cruise Saudi reserves the right to confine any Passenger who commits a crime onboard until law enforcement authorities can be contacted or board the Cruise Ship.

16.2 The safety of the Cruise Ship and all those onboard is of paramount consideration. Passengers must pay attention to and comply with all regulations and notices relating to the safety of the Cruise Ship, her crew and Passengers, the terminal facilities and immigration requirements.

16.3 Passengers must at all times conduct themselves in a manner which respects the safety, culture and privacy of other persons onboard and, if participating in a Shore Excursion, in a manner which respects the culture, traditions and laws of the local population. 16.4 Any illegal activity or disruptive behavior will not be tolerated. Passengers agree to follow Cruise Saudi’s Code of Conduct at all times. Any Passenger whose conduct affects the comfort, enjoyment, safety, or well-being of other Passengers or crew will be detained onboard or disembarked at their own expense and will be prohibited from sailing with Cruise Saudi in the future. In addition, Passengers or Passengers’ estates agree to defend and indemnify Cruise Saudi and the Cruise Ship, their servants and agents against liability which Cruise Saudi or the Cruise Ship or such servants or agents may incur towards any person, company, or government for any damage to property, personal injury, or death caused directly or indirectly, in whole or in part, by any illegal activity or disruptive behavior of Passengers and those Minors traveling with any Passenger.

16.5 Passengers shall not solicit anyone on the Cruise Ship for any commercial, professional, illegal, or illicit purposes. Passengers agree that any violation of this or any clause in these Terms and Conditions may subject Passengers to disembarkation with no refund to the Passenger and any such actions may cause the Passenger to be prohibited from sailing with Cruise Saudi in the future.

16.6 Passengers shall not conduct, participate or engage directly or indirectly in any games, activities, bet or wager for money or other personal property. Passengers acknowledge that gambling of any description is strictly prohibited onboard the Cruise Ship and during the Cruise.

16.7 Passengers must comply with any reasonable request made by any member of staff, the Master or their officers. All Passengers must take care for their safety whilst walking on outside decks. Passengers and Minors should not run around the decks or other parts of the Cruise Ship.

16.8 The Passenger will in any event be liable for any injury, loss or damage occasioned by their breach of any of the prohibitions in these Terms and Conditions and must indemnify Cruise Saudi against any claim in respect thereof.

17. PASSENGER ATTIRE

17.1 All Passengers should ensure that their clothing and accessories are respectful to fellow Passengers and are respectful of the relevant local culture and Applicable Law. Specifically, items worn during the Cruise should be modest and must not dress in outfits with photos, figures, signs, or phrases violating common decency.in reference to the link below:

17.2 If Cruise Saudi, in its reasonable opinion, finds that an item (or items) of clothing or accessories owned or worn by a Passenger has breached Clause 17.1, Cruise Saudi is entitled to (a) confiscate or destroy the offending item(s) of clothing without remuneration or compensation to the Passenger; or (b) disembark the Passenger with no refund of any part of the Cruise Fare or Total Fare.

18. FOOD AND BEVERAGE POLICY

18.1 Food and beverages are available for purchase onboard the Cruise Ship at fixed prices.

18.2 Cruise Saudi and or its servants and or agents may refuse to serve a Passenger food or beverages where, in Cruise Saudi’s reasonable opinion, the Passenger is likely to be a danger or nuisance to themselves, other Passengers or the Cruise Ship.

18.3 Unless otherwise stated in this Clause 18.3, in order to ensure safety and security standards, it is strictly forbidden to bring food or beverage onboard the Cruise Ship. Notwithstanding the aforementioned, Passengers are permitted to bring the following items onboard the Cruise Ship: (a) personal hygiene products, (b) cleansing products, (c) lotions, (d) fluid medications for therapeutic use, (e) baby gear, (f) baby food items, and (g) dietary items prescribed by a physician. Any local or “traditional” food or beverage items purchased during the Cruise in any port of call will be collected by Cruise Saudi or its servants or agents and returned to the Passenger at the end of the Cruise. Cruise Saudi will not be liable for any loss or damage to any food or beverage item(s) in its possession under this Clause 18.3.

18.4 During embarkation, all Luggage will be subject to a careful check to ensure that each Passenger has complied with Clause 18.3. Any food or beverage items found which do not comply with Clause 18.3 will be confiscated or destroyed by Cruise Saudi. Cruise Saudi will not be liable for any loss or damage to any food or beverage item(s) confiscated under this Clause 18.4.

18.5 In regards to food served through restaurants onboard the Cruise ship, the main restaurants are included, and therefore food in the main restaurants is paid for with the Cruise Fare. However, the specialty restaurants construe a surcharge as may be specified onboard Cruise ship.

19. ANIMALS AND PETS

19.1 Subject to Clause 19.3, animals or pets are not allowed onboard the Cruise Ship under any circumstances without Cruise Saudi’s permission in writing. Any such animals or pets brought onboard by the Passenger without permission will be taken into custody and arrangements will be made for the animal to be landed at the next port of call at the Passenger’s sole expense.

19.2 Whilst Cruise Saudi or its servants or agents will take such care as is reasonable in all the circumstances in relation to the pet or animal, neither the Master nor Cruise Saudi is liable to the Passenger in respect of any loss or injury to the animal or pet whilst in Cruise Saudi’s possession/custody.

19.3 Recognized assistance dogs are subject to and must comply with national and EU and or/Saudi Arabian Regulations as may be applicable to the Cruise regarding health, inoculations, training and travel. It is the Passenger’s responsibility to have all necessary papers and check the position prior to the Cruise and to be satisfied that the assistance dog can be carried to the ports of embarkation and disembarkation and that the assistance dog is not prohibited from going ashore at the various ports of call.

20. INDEPENDENT SERVICE PROVIDERS

20.1 The Cruise Ship carries onboard service providers who operate as independent contractors. Their services and products are charged as extras. Cruise Saudi is not responsible for their services or products. These contractors may include, without limitation, hairdressers, beauticians, manicurists, masseuses, photographers, entertainers, fitness or sports instructors, shopkeepers and others providing services. The limitations referred to in Clauses 26 and 27 shall apply to all independent contractors.

20.2 Cruise Saudi is not responsible for services provided or products sold by any independent contractor to Passengers. Charges for such services or products which Passengers request or purchase will be the sole responsibility of such Passenger.

21. TRAVEL PACKAGES AND SHORE EXCURSIONS

21.1 Hotel accommodation and all transport (other than the Cruise Ship) included in any Package or Shore Excursions, are operated by Cruise Saudi or independent contractors, even if sold by agents of Cruise Saudi or Travel Agents onboard the Cruise Ship.

21.2 The terms of these Terms and Conditions, including limitation of liability, are applicable to the Shore Excursion, activity, service or product purchased or provided, whether in the form of a ticket coupon or voucher, whether before or after embarkation.

21.3 Each Passenger is responsible for making due inquiries requiring the details of any Shore Excursion or any other activity or service provided on the Cruise Ship or Cruise, and to determine their ability to safely participate.

21.4 Information and instructions are in Arabic as the primary language for all Cruises but any Shore Excursions, products, services, activities, and travel before and after the Cruise, may include interaction in foreign countries or with foreign providers where Arabic is not the primary language.

22. UNAUTHORISED STOPOVER AND DISEMBARKATION

22.1 Unauthorized stopover or disembarkation or failure to make any sailing of the Cruise Ship at any port shall be at the Passenger's sole risk and expense. A Passenger may be refused subsequent boarding, and such Passenger will not be entitled to any refund, payment, compensation or future cruise credit of any kind. If a Passenger plans to disembark the Cruise Ship and/or to off load packages, boxes, or Luggage before their authorized port of call, such Passenger must notify Cruise Saudi no later than twenty four (24) hours before arrival in that port to arrange an inspection of the Passenger and/or the Passenger's belongings by local customs authorities, if required. Should any Passenger fail to adhere to this requirement and the Passenger and/or the Passenger's belongings are not presented for inspection, such Passenger may be assessed monetary penalties by local authorities. Furthermore, each Passenger agrees to assume and/or reimburse Cruise Saudi for any expenses or fines that may be incurred as a result of such non-compliance. Each Passenger acknowledges that for round trip Cruises commencing in a country that stop in other ports of that country, Passengers may visit but may not permanently disembark in any port in that country other than the port of embarkation. If Passengers do disembark in a different port in that country, a fine or penalty may be imposed by that country’s government. In consideration of the Cruise Fare or Total Fare, Passengers hereby agree to pay any such fine or penalty imposed because of a failure to complete the entire Cruise.

23. MEDICAL SERVICES AND TREATMENT

23.1 Medical services are available onboard the Cruise Ship as a convenience to the Passenger. The Cruise Ship's doctor and medical personnel are independent contractors and are entitled to charge Passengers for use of any medical facilities, any medical services and medicines provided. The Cruise Ship's doctor and medical personnel are not under the control or supervision of the Master or Cruise Saudi when treating Passengers. Cruise Saudi shall not be liable in any way for any medical facilities, services or medicines provided or not provided by the Cruise Ship's doctor and medical personnel.

23.2 Medical facilities onboard and in the various ports of call may be limited. Cruise Saudi shall not be liable in any way for referring Passengers ashore for medical facilities, services, products or for the actual medical services rendered ashore. In the event that medical attendance of any kind or ambulance assistance, whether on shore, at sea or by air is required and is provided or ordered by the Passenger or Cruise Saudi or the Master or the doctor, the Passenger concerned shall be liable for the full charge or cost thereof and shall fully indemnify Cruise Saudi upon first demand of any costs incurred by Cruise Saudi, its servants or agents.

23.3 It is the Passenger’s obligation and responsibility to seek medical assistance from the qualified doctor onboard the Cruise Ship as and when necessary during the Cruise.

23.4 The Cruise Ship’s doctor is not a specialist and the Cruise Ship’s medical center is not required to be and is not equipped to the same standards as a land-based hospital. The Cruise Ship carries medical supplies and equipment as required by its flag state. Neither Cruise Saudi nor the Cruise Ship's doctor shall be liable to the Passenger as a result of any inability to treat any medical condition as a result.

23.5 In the event of illness or accident, Passengers may have to be landed ashore by Cruise Saudi and/ or Master for medical treatment. Cruise Saudi makes no representations regarding the quality of medical treatment at any port of call or at the place at which the Passenger is landed. Medical facilities and standards vary from port to port and Cruise Saudi makes no representations or warranties in relation to such standards.

23.6 Passengers are advised to ensure that their insurance covers medical treatment, including any emergency repatriation costs.

23.7 In relation to medical equipment which the Passenger intends to bring onboard it is the responsibility of the Passenger to arrange delivery of all medical equipment to the cruise terminal prior to departure and it is the requirement for Passengers to notify at the time of booking if they need to have medical equipment on board is to ensure that the medical equipment can be carried or carried safely.

23.8 It is the Passenger’s responsibility to ensure that all medical equipment is in good working order and for arranging enough equipment and supplies to last the entire Cruise.

23.9 Passengers must be able to operate all equipment. If there are any particular conditions, any Disabled Passengers which require personal care or supervision then such personal care or supervision must be organized by the Passenger and at the Passenger’s expense. The Cruise Ship is unable to respite services, one to one personal care or supervision or any other form of carer for physical or psychiatric or other conditions.

24. ENVIRONMENTAL POLICY

24.1 All Passengers must adhere to the Applicable Law on environmental matters, including but not limited to Cruise Saudi's Environmental Policy. Any littering, dumping or pollution of any kind whether at sea or ashore, including the discharge of any item in any place, including but not limited to the ocean, waterways or beaches is strictly prohibited. Passengers will be strictly liable for any illegal littering, dumping or pollution.

24.2 Any willful or negligent act of discharging or releasing any unauthorized item overboard, without the express permission of the Cruise Ship's staff may result in a charge of SAR 2,000, per violation.

24.3 Fines or charges will be imposed using the functional currency of the Cruise Ship, which may be different than the form of currency used to secure the booking.

24.4 Passengers will be charged the reimbursement cost of any unauthorized discharged property belonging to Cruise Saudi.

24.5 Passengers shall also be responsible for any fines or penalties imposed on Cruise Saudi by any government, governmental agency or official, port or port official, or for expenses or losses caused or incurred for Passenger's violation of any Applicable Law or Cruise Saudi's Environmental Policy.

24.6 Violation of this policy may result in the disembarkation of all Passengers in the cabin. Passengers who are disembarked for breaching Clause 24.1 shall be responsible for all financial charges and expenses to return home, and no refund of their fare will be provided.

24.7 Passengers who breach this Clause 24 may be prohibited from sailing with Cruise Saudi in the future.

25. PRIVACY POLICY

25.1 From time to time Cruise Saudi may utilize closed circuit television cameras or other surveillance means onboard the Cruise Ship. Passengers acknowledge and agree that such devices may be recording, and that videos and images of the Passengers may be stored and used as deemed necessary by Cruise Saudi to comply with law, applicable regulations, governmental and quasi-governmental requests or orders, or any legal investigation or claims process.

25.2 Calls made to Cruise Saudi, and calls received from Cruise Saudi, may be recorded for the purposes of audit, training and the monitoring of services provided by Cruise Saudi.

25.3 Passengers agree Cruise Saudi has, at all times with or without notice, the right to enter and search a Passenger's cabin, personal safe or storage spaces, or to search or screen any Passenger, or personal effects, at any location, to ensure compliance with any of the restrictions set forth in these Terms and Conditions. Any Passenger who refuses any such search or screening may be denied boarding or disembarked and no partial or total refund of the Cruise Fare or Total Fare will be issued.

25.4 The personal data Passengers provide to Cruise Saudi, or which is obtained through Passengers' dealings with Cruise Saudi or with its affiliates, or which is obtained through Cruise Saudi's Infectious Disease Protocols will be processed in accordance with Cruise Saudi's Privacy Notice, which describes how personal data may be processed, and which is available on the Cruise Saudi website. Cruise Saudi may from time to time change its privacy notice; you can find the up-to-date privacy notice on the Privacy Notice page or by writing to Cruise Saudi. Passengers may provide personal data to Cruise Saudi that may include names, postal or email addresses, date of birth, passport information, financial account, telephone numbers, likenesses, photographs or other information which would identify Passengers personally. Passengers may also provide Cruise Saudi or others certain sensitive data such as health, medical, dietary, religious or gender information. Passengers agree that Cruise Saudi may:

(a) keep their personal and sensitive data;

(b) use it in its business worldwide in accordance with its published privacy notice;

(c) share it with its affiliated or related companies; and

(d) subject it to processing worldwide provided Cruise Saudi's safeguards are used.

Passengers agree that any personal or sensitive data provided to Cruise Saudi in the European Economic Area may be used, processed and transferred worldwide.

25.5 Passengers agree that Cruise Saudi may disclose personal or sensitive data to unaffiliated third parties in accordance with the Applicable Law:

(a) with the Passenger's consent or authorization;

(b) to help complete a transaction for the Passenger;

(c) to comply with law, applicable regulations, governmental and quasi-governmental requests, orders or legal processes, or Cruise Saudi's Infectious Disease Protocols;

(d) to enforce these Terms and Conditions or other agreements or protect the rights, safety or property of Cruise Saudi or others;

(e) as part of a purchase, sale, or transfer of assets or Cruise Saudi's business;

(f) to Cruise Saudi's agents or service providers to perform functions on its behalf; or

(g) as otherwise described in Cruise Saudi's privacy notice, as amended from time to time,

in each case, as applicable.

26. USE OF PASSENGER'S LIKENESS

26.1 Each Passenger grants Cruise Saudi or its promotional partners the exclusive right to include photographic, video and other visual portrayals of Passengers in any medium of any nature whatsoever for any purpose including without limitation trade, advertising, sales, publicity or otherwise, without compensation to such Passenger, and all rights, title and interest therein (including all worldwide copyrights therein) shall be Cruise Saudi's sole property, free from any claims by the Passenger or any person deriving any rights or interest from the Passenger. Each Passenger understands and agrees that professional onboard photographers may photograph the Passenger, and that those photos may be processed, displayed and sold to Passengers and others.

26.2 For data protection purposes, Cruise Saudi is the controller of, and responsible for, the personal data comprising the visual portrayal of the Passenger as referenced in Clause 25.1, and Cruise Saudi will ensure that it will comply with the requirements of all legislation and regulations in force from time to time relating to the use of the visual portrayal of the Passenger and process such imagery in accordance with Cruise Saudi's Privacy Notice, which is available on the Cruise Saudi website.

26.3 Each Passenger has the right to withdraw the consent given in Clause 25.1 at any time by writing to Cruise Saudi at DPO@aroya.com. This will not affect the lawfulness of any processing carried out before the Passenger withdrew consent.

27. FORCE MAJEURE

In addition to the exclusions set out elsewhere in these Terms and Conditions including but not limited to the Infectious Disease Protocol, Cruise Saudi shall not be liable for any loss, injury, damage, or inability to perform the Cruise or the Package (whether in whole or in part), arising from any force majeure event such as, but not limited to: war (declared or undeclared), terrorism – actual or threatened – fire, natural disasters, acts of God, labor strikes, bankruptcy, failure of subcontractors or independent contractors to perform, epidemics or pandemics of communicable diseases (including but not limited to COVID-19, influenza, norovirus), governmental restraints or declarations relating to epidemics or pandemics, other restraints of any governmental authority, health emergencies, or any other events beyond Cruise Saudi's control or any events which are unusual or unforeseeable.

28. LIMITATION OF LIABILITY

28.1 THE LIABILITY (IF ANY) OF CRUISE SAUDI FOR DAMAGES SUFFERED AS A RESULT OF DEATH OR PERSONAL INJURY TO THE PASSENGER, OR LOSS OR DAMAGE TO LUGGAGE SHALL BE SUBJECT TO THE FOLLOWING LIMITATIONS AND SHALL BE DETERMINED IN ACCORDANCE WITH THE FOLLOWING:

(a) THE INTERNATIONAL CONVENTION RELATING TO THE CARRIAGE OF PASSENGERS AND THEIR LUGGAGE BY SEA, ADOPTED IN ATHENS ON 13 DECEMBER 1974 AND (THE ATHENS CONVENTION), AS SUBSEQUENTLY AMENDED/SUPPLEMENTED IN 2002 AND AS INCORPORATED WITH EFFECTS FROM 1 JANUARY 2013 BY EU REGULATION 392/2009 CONCERNING THE RIGHTS OF PASSENGERS WHEN TRAVELLING BY SEA IN THE EVENT OF ACCIDENTS (EU REGULATION 392/2009), SHALL APPLY TO INTERNATIONAL CARRIAGE BY SEA WHERE THE PORT OF EMBARKATION OR DISEMBARKATION IS IN THE EU OR WHERE THE CRUISE SHIP HAS AN EU FLAG OR WHERE THE CONTRACT OF CARRIAGE IS MADE IN THE EU. THE PROVISIONS OF THE ATHENS CONVENTION AND, WHERE APPLICABLE, EU REGULATION 392/2009 ARE HEREBY EXPRESSLY INCORPORATED INTO THESE TERMS AND CONDITIONS.

(b) COPIES OF THE ATHENS CONVENTION AND EU REGULATION 392/2009 ARE AVAILABLE ON REQUEST AND CAN BE DOWNLOADED FROM THE INTERNET AT WWW.IMO.ORG. CRUISE SAUDI SHALL BE ENTITLED TO THE BENEFIT OF ALL THE LIMITATIONS, RIGHTS AND IMMUNITIES PROVIDED BY THE ATHENS CONVENTION AND, WHERE APPLICABLE, EU REGULATION 392/2009 INCLUDING THE FULL DEDUCTIBLE UNDER ARTICLE 8(4) OF THE ATHENS CONVENTION. THE LIABILITY OF CRUISE SAUDI FOR DEATH, PERSONAL INJURY OR ILLNESS TO THE PASSENGER SHALL NOT EXCEED 46.666) SPECIAL DRAWING RIGHTS (SDR) AS PROVIDED AND DEFINED IN THE ATHENS CONVENTION OR, WHERE APPLICABLE, THE MAXIMUM SUM OF 400,000) SDR PURSUANT TO EU REGULATION 392/2009 AND, WHERE THERE IS LIABILITY FOR WAR AND TERRORISM, 250,000 SDR. LIABILITY OF CRUISE SAUDI FOR LOSS OF OR DAMAGE TO LUGGAGE OR OTHER PROPERTY SHALL NOT EXCEED 833 SDR PER PASSENGER UNDER THE ATHENS CONVENTION OR 2,250 SDR WHERE EU REGULATION 392/2009 APPLIES. IT IS AGREED THAT SUCH LIABILITY OF CRUISE SAUDI SHALL BE SUBJECT TO A DEDUCTIBLE OF 13 SDR PER PASSENGER, SUCH SUM TO BE DEDUCTED FROM THE LOSS OR DAMAGE TO LUGGAGE OR OTHER PROPERTY.

(c) THE PASSENGER UNDERSTANDS THAT THE CONVERSION RATE OF SDR'S FLUCTUATES DAILY AND MAY BE OBTAINED FROM A BANK OR INTERNET. THE VALUE OF AN SDR CAN BE CALCULATED BY VISITING HTTPS://WWW.IMF.ORG/EXTERNAL/NP/FIN/DATA/RMS_FIVE.ASPX. IF ANY PROVISION OF THESE TERMS AND CONDITIONS IS RENDERED NULL AND VOID BY THE ATHENS CONVENTION OR EU REGULATION 392/2009, SUCH INVALIDITY SHALL BE LIMITED TO ONLY THAT PARTICULAR CLAUSE.

(d) CRUISE SAUDI’S LIABILITY IN RELATION TO DEATH OR PERSONAL INJURY IS LIMITED AND SHALL IN NO CIRCUMSTANCES WHATSOEVER EXCEED THE LIMITS OF LIABILITY SET OUT UNDER THE ATHENS CONVENTION OR, WHERE APPLICABLE, EU REGULATION 392/2009.

(e) CRUISE SAUDI WILL BE LIABLE IN RELATION TO DEATH OR PERSONAL INJURY OR LOSS OF OR DAMAGE TO LUGGAGE IN THE EVENT THAT CRUISE SAUDI OR ITS SERVANTS OR AGENTS ARE GUILTY OF “FAULT OR NEGLECT”, AS REQUIRED BY ARTICLE 3 OF THE ATHENS CONVENTION, OR WHERE THERE IS LIABILITY FOR A SHIPPING INCIDENT, WHERE EU REGULATION 392/2009 APPLIES. THE LIMITS OF LIABILITY UNDER THE TERMS OF THE ATHENS CONVENTION SHALL BE APPLICABLE TO CRUISE SAUDI’S SERVANTS OR AGENTS OR INDEPENDENT CONTRACTORS IN ACCORDANCE WITH ARTICLE 11 OF THE ATHENS CONVENTION. ANY DAMAGES PAYABLE BY CRUISE SAUDI SHALL BE REDUCED IN PROPORTION TO ANY CONTRIBUTORY NEGLIGENCE BY THE PASSENGER AS PROVIDED IN
ARTICLE 6 OF THE ATHENS CONVENTION.

(f) IT IS PRESUMED UNDER THE ATHENS CONVENTION AND WHERE APPLICABLE EU REGULATION 392/2009 THAT CRUISE SAUDI HAS DELIVERED LUGGAGE TO A PASSENGER UNLESS WRITTEN NOTICE IS GIVEN BY THE PASSENGER WITHIN THE FOLLOWING PERIODS:

         (i) IN THE CASE OF APPARENT DAMAGE BEFORE OR AT THE TIME OF DISEMBARKATION OR REDELIVERY; AND
        (ii) IN THE CASE OF DAMAGE WHICH IS NOT APPARENT OR LOSS OF LUGGAGE WITHIN 15 DAYS FROM THE DISEMBARKATION OR DELIVERY OR OF THE DATE THAT SUCH DELIVERY SHOULD HAVE TAKEN PLACE.

28.2 IF THE CARRIAGE PROVIDED HEREUNDER IS NOT “INTERNATIONAL CARRIAGE” AS DEFINED IN ARTICLE 2 OF THE ATHENS CONVENTION OR THE CRUISE SHIP IS BEING USED AS A FLOATING HOTEL OR NON-INTERNATIONAL CARRIAGE BY SEA, THE REMAINING PROVISIONS OF THE ATHENS CONVENTION AND, WHERE APPLICABLE, EU REGULATION 392/2009 SHALL APPLY TO THESE TERMS AND CONDITIONS AND BE DEEMED TO BE INCORPORATED HEREIN MUTATIS MUTANDIS.

28.3 CRUISE SAUDI SHALL NOT BE LIABLE FOR LOSS OR DAMAGE TO ANY VALUABLES SUCH AS MONIES, NEGOTIABLE SECURITIES, PRECIOUS METAL ITEMS, JEWELLERY, ART, CAMERAS, COMPUTERS, ELECTRONIC EQUIPMENT, OR ANY OTHER VALUABLES UNLESS THEY ARE DEPOSITED WITH CRUISE SAUDI FOR SAFE-KEEPING, AND A HIGHER LIMIT IS AGREED EXPRESSLY AND IN WRITING AT THE TIME OF DEPOSIT, AND AN EXTRA CHARGE IS PAID BY THE PASSENGER FOR DECLARED VALUE PROTECTION. USE OF THE CRUISE SHIP’S SAFE IS NOT A DEPOSIT WITH THE CRUISE SHIP OR CRUISE SAUDI. WHERE THERE IS LIABILITY FOR LOSS OF OR DAMAGE TO VALUABLES DEPOSITED WITH THE CRUISE SHIP THEN SUCH LIABILITY IS LIMITED TO 1,200 SDR UNDER THE ATHENS CONVENTION OR 3,375 SDR WHERE EU REGULATION 392/2009 APPLIES. CRUISE SAUDI AND THE PASSENGER AGREE NOT TO DEMAND ANY SECURITY FROM THE OTHER IN CONNECTION WITH A CLAIM OF ANY KIND. THE PASSENGER WAIVES THE RIGHT TO ARREST THE CRUISE SHIP OR TO ATTACH ANY OTHER ASSET OWNED, CHARTERED OR OPERATED BY CRUISE SAUDI. IF THE CRUISE SHIP IS ARRESTED OR ATTACHED, THEN THE CRUISE SHIP AND CRUISE SAUDI SHALL HAVE THE RIGHT TO ANY LIMITATION AND ALL DEFENCES AVAILABLE HEREIN.

28.4 IN ADDITION TO THE RESTRICTIONS AND EXEMPTIONS FROM THE LIABILITY PROVIDED IN THESE TERMS AND CONDITIONS, CRUISE SAUDI SHALL HAVE FULL BENEFIT OF ANY APPLICABLE LAWS PROVIDING FOR LIMITATION OR EXONERATION OF LIABILITY (INCLUDING WITHOUT LIMITATION, LAW OR THE LAWS OF THE CRUISE SHIP’S FLAG IN RESPECT OF/OR THE GLOBAL LIMITATION ON DAMAGES RECOVERABLE FROM CRUISE SAUDI). NOTHING IN THESE TERMS AND CONDITIONS IS INTENDED TO OPERATE TO LIMIT OR DEPRIVE CRUISE SAUDI OF ANY SUCH STATUTORY OR OTHERWISE LIMITATION OR EXONERATION OR LIABILITY. THE SERVANT OR AGENTS OF CRUISE SAUDI SHALL HAVE THE FULL BENEFIT OF ALL SUCH PROVISIONS RELATING TO THE LIMITATION OF LIABILITY.

28.5 WITHOUT PREJUDICE TO CLAUSES 28.1 TO 28.4 ABOVE, IF ANY CLAIM IS BROUGHT AGAINST CRUISE SAUDI IN ANY JURISDICTION WHERE THE APPLICABLE EXEMPTIONS AND LIMITATIONS INCORPORATED IN THESE TERMS AND CONDITIONS ARE HELD TO BE LEGALLY UNENFORCEABLE THEN CRUISE SAUDI SHALL NOT BE LIABLE FOR DEATH, INJURY, ILLNESS, DAMAGE, DELAY OR OTHER LOSS OR DETRIMENT TO ANY PERSON OR PROPERTY ARISING OUT OF ANY CAUSE OF WHATSOEVER NATURE WHICH HAS NOT BEEN SHOWN TO HAVE BEEN CAUSED BY CRUISE SAUDI’S OWN NEGLIGENCE OR FAULT.

28.6 NO COMPENSATION IS PAYABLE BY CRUISE SAUDI TO ANY PASSENGER FOR ANY EMOTIONAL STRESS, MENTAL ANGUISH OR PSYCHOLOGICAL INJURY OF ANY KIND SAVE WHERE LEGALLY RECOVERABLE AGAINST CRUISE SAUDI AS A RESULT OF ANY INJURY CAUSED BY AN ACCIDENT DUE TO THE FAULT OR NEGLIGENCE OF CRUISE SAUDI.

29. PASSENGER'S LIABILITY FOR DAMAGE

THE PASSENGER SHALL BE LIABLE FOR AND SHALL REIMBURSE CRUISE SAUDI FOR ANY ACTUAL DAMAGE TO THE CRUISE SHIP OR ITS FURNISHINGS OR EQUIPMENT OR ANY OTHER PROPERTY OF CRUISE SAUDI DIRECTLY CAUSED BY ANY WILFUL OR NEGLIGENT ACT OR OMISSION BY THE PASSENGER OR ANY PERSON FOR WHOM THE PASSENGER IS RESPONSIBLE SUCH AS MINORS OR DISABLED PASSENGERS.

30. OVERSTAYING

Passengers who remain onboard after the arrival of the Cruise Ship at its final port of destination and after Passengers have been asked to disembark will be required by Cruise Saudi to pay for their accommodation and maintenance at the then published rates for every night they remain onboard.

31. GENERAL AVERAGE

Passengers will not be liable to pay, nor be entitled to receive, any general average contribution in respect of property taken with them on the Cruise Ship.

32. CLAIMS

32.1 Cruise Saudi shall be under no liability whatsoever in respect of any claim arising from an accident or incident which was not reported by the Passenger to the Master whilst onboard the Cruise Ship.

32.2 Notices of claim for death, illness, emotional stress or personal injury, with full particulars in writing shall be given to Cruise Saudi and the Cruise Ship within six (6) months after the date such death, injury, or illness occurs.

32.3 Notices of a claim for loss or damage to Luggage or other property shall be given to Cruise Saudi in writing before or at the time of disembarkation, or if not apparent, within fifteen (15) days from the date of disembarkation.

32.4 Complaints concerning accessibility, cancellation or delays must be made to Cruise Saudi within two (2) months from the date the service was performed. Cruise Saudi shall respond within one (1) month to advise whether the complaint is substantiated, has been rejected or is still being considered. A final reply shall be provided within two (2) months. The Passenger shall provide such further information as may be required by Cruise Saudi to deal with such a complaint. If the Passenger is not satisfied with the response, then they may complain to the relevant enforcement body in the country of embarkation/Saudi Arabia.

32.5 All claims against Cruise Saudi or the Cruise Ship for death, illness, emotional stress or personal injury to a Passenger or for loss or damage to Luggage or other property shall be time barred after two (2) years from the date of disembarkation.

33. GOVERNING LAW AND JURISDICTION

33.1 The applicable law for these Terms and Conditions shall be laws of Saudi Arabia.

Unless differently provided by any Applicable Law, for all claims against Cruise Saudi shall be brought in and be subject to the exclusive jurisdiction of the competent courts in Jeddah, Saudi Arabia.

34. Products & Packages

AROYA Cruises Laundry Service (Packages)

  • Exceeding the allowed number of garments may require additional charges at individual menu prices.
  • Only for wash and press services.

Turnaround Times & Delivery:

  • Items are collected before 12:00 noon, returned before noon the next day.

Lost or Damaged Items:

  • AROYA Cruises cannot accept responsibility for shrinkage or fastness of colour. Any claim whatsoever concerning garments must be reported within 24 hours accompanied with the guest copy of the laundry list.
  • AROYA Cruises’ liability for either loss or damage will not exceed the amount of five (5 times) the laundry/drycleaning/pressing charge.
  • It is recommended to label your delicate or valuable clothing for identification purposes, and write any cleaning instructions in line with the care label of item.

Payment:

  • Pre-sailing purchase of the packages can be done through AROYA Cruises website or Contact Centre
  • Onboard purchase of the packages can be done through Guest Services Desk or selecting it through the laundry form.
  • Laundry services will be charged to your onboard account.
  • Charges will be reflected in your final statement.

AROYA Cruises Drink Packages

Purchase and Availability

  • Soft Drinks Packages can be purchased in advance of your cruise through AROYA Cruises website or Contact Centre or on board.
  • Soft Drinks Packages must be purchased for the remaining duration of your cruise. They cannot be purchased on a per-day basis.
  • Guests will be entitled to 15 drinks per day.
  • Kids soft drink packages are for guests aged between 2 years old to 12 years old.
  • Guests are entitled to upgrade to the next package by paying the price difference.
  • Consumed drinks allowance will be carried to the next upgraded package.

  • Provide beverages to other Guests or do not comply with the terms, conditions and limitations of the package.
  • Exhibit behaviour that is inappropriate, a safety risk to themselves or others, or become offensive or disruptive to our other cruise guests or staff.
  • Exceed, or attempt to circumvent, the daily limits and service limitations will be treated according to the Passenger Carriage Terms and Conditions.

Connection & Speed:

  • Wi-Fi service utilizes satellite technology, and connection speeds may vary depending on weather conditions, ship location, and overall users traffic.
  • AROYA Cruises does not guarantee a specific connection speed.

Device Limits & Usage:

  • Most packages allow you to connect multiple devices to your account.
  • Additional device connections may require separate package purchases.
  • Downloading large files, streaming videos, or using video conferencing applications may significantly impact your data allowance.

Service Availability:

  • Wi-Fi service may be unavailable in certain areas of the ship or during port calls.
  • We will make every effort to notify guests of any planned service interruptions.

Security & Privacy:

  • You are responsible for the security of your devices and any data transmitted while using the ship's Wi-Fi.
  • We recommend using a strong password and exercising caution when accessing personal information online.
  • AROYA Cruises is not responsible for any data breaches or security vulnerabilities experienced while using the Wi-Fi service.

Terms & Termination:

  • Wi-Fi packages are valid for the duration of your cruise and cannot be carried over to future sailings.
  • AROYA Cruises reserves the right to suspend or terminate your Wi-Fi access for violating these terms and conditions or for engaging in illegal or malicious activities online.

Purchasing & Payment:

  • Wi-Fi packages can be purchased through AROYA Cruises Website or Contact Centre before your cruise or onboard the ship through the Wi-Fi portal.
  • Payment for Wi-Fi packages will be charged to your onboard account.
  • We recommend reviewing the available Wi-Fi packages and choosing the one that best suits your internet usage needs. For any questions or assistance, please do not hesitate to contact Guest Services.

In-Cabin Experience Packages

Booking and payment and cancellation

  • Book through AROYA Cruises website, or onboard via Guest Services.
  • Payment must be made in full at the time of booking.
  • For cancellations that occur 1 full day or more prior to the sailing date, a full refund will automatically be posted to the form of payment that was used to pay for the package. This policy is effective regardless of whether or not the person who purchased the package is sailing. For credit card payments, it will take 10-15 business days for the credit to reflect on the credit card account.


Regarding some contents of the package

  • Dinner for 2 can be used with prior reservation on restaurants Bamboo Kitchen (dinner only), La Tavola or Irth either for lunch or dinner.
  • Neon signage included in this package is for the guest to take home if they wish to do so.
  • AROYA Cruises bathrobes are to be used onboard only and to be returned at the end of the cruise. Any bathrobes not returned will be charged accordingly at it is full price to the guest's account.

Liability and Responsibility

  • AROYA Cruises is not liable for injuries, damages, or losses resulting from acquiring one of the In-Cabin Experience Packages.
  • Guests are welcome to consume all items included in their chosen Experience Packages throughout their cruise.
  • Package is of one time delivery and there is no refill involved.
  • Additional items can be replenished by purchasing another Experience Package.
  • Any unused items will not be refunded.


Allergies

  • Guests with known allergies are advised to inform AROYA Cruises in advance or once onboard.
  • AROYA Cruises will make every effort to accommodate dietary restrictions and allergies.
  • Despite precautions, AROYA Cruises cannot guarantee a completely allergen-free environment.
  • Guests with severe allergies should take necessary precautions and carry appropriate medication.
  • AROYA Cruises is not liable for any allergic reactions and complications that may occur as a result of consuming an item from the purchased in cabin Experience Package.

Eligibility:

  • Access to Al Majlis is a privilege reserved for guests residing in Suites and Villas or holding VIP Status with AROYA Cruises.
  • A valid AROYA Cruises Pass or status card will be required for entry.

Reservations & Fees:

  • Al Majlis operates on a limited capacity basis. Reservations are required to guarantee access. Please visit the Concierge Desk at the VIP Club or ask your butler to reserve your desired time slot(s).
  • Per-hour access fees apply and will be charged directly to your onboard account at the time of reservation.
  • Minimum booking time is 1 hour.
  • There are no cancelation fees.

Arrival & Check-In:

  • Please arrive at Al Majlis at least 5 minutes before your reserved time slot.
  • A dedicated staff member will greet you and confirm your reservation.

  • The amount paid will be credit consumed at designated lounges, where orders will be delivered to your booked Cabana and only consumed during your booked time.
  • Cabanas can be reserved of 4 hours’ time slots.

  • At least 24 hrs reservation is required to book one of these packages.
  • Packages fees will be charged to the onboard account of the guest booking the service and they are non-refundable.

Arrival & Check-In:

  • Please arrive at the booked corporate room at least 10 minutes before the event.
  • A dedicated staff member will greet you and confirm your reservation.
  • Packages will be ready set-up 15 minutes before the event starts.

  • If you experience any discomfort, dizziness, nausea, or other concerning symptoms during the VR experience, you must immediately stop using the equipment and notify a staff member.

Usage Guidelines:

  • F&B is not allowed inside the escape room.
  • Children must be accompanied by an adult at all times.
  • Pregnant guests and individuals with certain medical conditions may be advised against participating in the escape room experience.
  • Guests should refrain from running, jumping, climbing, or engaging in any behaviour that may pose a risk of injury to themselves or others.
  • Participants are responsible for the proper use and care of any equipment or props provided in the escape room.

  • Entering the Escape Room is not allowed for late arrivals.

  • Children who are not yet potty-trained require a diaper change every 2 hours. Parents are responsible for providing diapers and wipes.

  • Reservations are required to guarantee availability. Please visit the Kids Club Reception desk or book your desired time slots through AROYA Cruises App.
  • Per-hour rates apply, charged to your onboard account at drop-off.
  • Minimum booking time is 1 hour.

Arrival & Check-In:

  • Please arrive at the Nursery at least 10 minutes before your reserved time slot.
  • A staff member will complete a check-in process, including a health screening and review of your child's emergency contact information.
  • For security purposes, parents/guardians should present their AROYA Cruises Pass at check-in.

Late Pick-Up:

  • A late pick-up fee of SAR 20 per 15 minutes will be charged to your onboard account if your child is not retrieved within 15 minutes of the designated pick-up time.

Illness Policy:

  • In the interest of all children's health, we cannot accept children who are exhibiting any signs of illness, such as fever, vomiting, or diarrhoea.
  • If your child becomes unwell while in our care, parents will be contacted immediately to pick them up. There will be no refunds for unused portions of a reserved time slot due to illness.

  • Please inform staff of any allergies or dietary restrictions your child may have.
  • We recommend sending your child with a labelled bottle or sippy cup filled with their preferred beverage.
  • We cannot accommodate outside food due to hygiene regulations.

Personal Belongings:

  • We recommend labelling all of your child's belongings with their name.
  • The nursery is not responsible for lost or damaged personal items.

Security & Supervision:

  • Our nursery is staffed by trained and certified caregivers who are committed to providing a safe and nurturing environment for your child.
  • We maintain a low child-to-caregiver ratio to ensure proper supervision at all times.
  • For security reasons, the nursery entrance is monitored, and only authorized personnel are allowed entry.

AROYA Cruises Laundry Service (Menu)

Lost or Damaged Items:

  • AROYA Cruises cannot accept responsibility for shrinkage or fastness of colour. Any claim whatsoever concerning garments must be reported within 24 hours accompanied with the guest copy of the laundry list.
  • The AROYA Cruises’ liability for either loss or damage will not exceed the amount of five (5 times) the laundry/drycleaning/pressing charge.
  • It is recommended to label your delicate or valuable clothing for identification purposes, and write any cleaning instructions in line with the care label of item.

Turnaround Times & Delivery:

Regular:

  • Received before 08:00 am returned same day by 8:00 pm
  • Received After 08:00 am will be returned the next day by Noon.​
  • Pressing only will be delivered within 6 hrs

Express Service:

  • Received before 12:00 noon will be returned by 08:00 pm same day.
  • 50 % surcharge on top

Payment:

  • Laundry service can be requested through filling out the laundry form and contacting guest services.
  • Laundry services can be paid for using your onboard account.
  • Charges will be reflected in your final statement.
  • Latest to have this service is by the last evening of the cruise 5PM (There is no laundry service on disembarkation day)
  • Paid services are non-refundable
